Arbitration

In the event that resolution under the presentation requirements of the Government Claims Act is not successful in resolving your claim, you agree to abide by the following:

  1. Arbitration Agreement: To the maximum extent permitted by law, you and Palomar Health each agree that any and all disputes or claims that have arisen or may arise between you and Palomar Health, including without limitation federal and state statutory claims, common law claims, and those based in contract, tort, fraud, misrepresentation or any other legal theory, will be resolved exclusively through final and binding arbitration. This agreement to arbitrate is intended to be broadly interpreted. The Federal Arbitration Act governs the interpretation and enforcement of this agreement to arbitrate.
  2. Arbitration Venue: Following the procedures set forth in the Government Claims Act, either you or Palomar Health may initiate arbitration. You and Palomar Health each agree to use JAMS (https://www.jamsadr.com/) and to submit any demand for arbitration through JAMS’ process. You and Palomar Health agree to the jurisdiction of the JAMS arbitrator over any dispute between you and Palomar Health, unless you and Palomar Health agree otherwise in writing. If JAMS is not available to administer the dispute, you and Palomar Health agree to use an arbitrator from the American Arbitration Association (https://www.adr.org/).
  3. No Class Actions: To the maximum extent permitted by law, you and Palomar Health agree that each of us may bring claims against the other only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding. Unless both you and Palomar Health agree otherwise, the arbitrator(s) may not consolidate or join more than one person’s or party’s claims and may not otherwise preside over any form of a consolidated, representative or class proceeding. Also, the arbitrator(s) may award relief (including monetary, injunctive and declaratory relief) only in favor of the individual party seeking relief and only to the extent necessary to provide relief necessitated by that party’s individual claim(s) and in keeping with the damages limitations in the Limitations on Damages section above.
  4. Arbitration Procedures: Arbitration is more informal than a lawsuit in court. Arbitration uses a neutral arbitrator or arbitrators instead of a judge or jury, and court review of an arbitration award is very limited. However, the arbitrator can award the same damages and relief on an individual basis that a court can award to an individual. All issues are for the arbitrator to decide, except that a court of competent jurisdiction may decide issues relating to arbitrability, the scope or enforceability of this agreement to arbitrate, or issues that these Terms of Use indicate that a court can resolve.

Any arbitration will be administered by JAMS, a well-respected arbitration and mediation service. For all claims in which the value of the relief sought is $10,000 or less, JAMS’ Streamlined Arbitration Rules and Procedures, as modified by these Terms of Use, will apply without exception unless otherwise agreed to in writing by both you and Palomar Health. For all other claims, JAMS’ Comprehensive Rules, as modified by these Terms of Use, apply. All of JAMS’ rules are available on their website at https://www.jamsadr.com/adr-rules-procedures/.

The arbitrator must decide the substance of all claims in accordance with applicable law, including recognized principles of equity, and will honor all claims of privilege recognized by law. No court or arbitrator is bound by rulings in prior arbitrations involving different users of Palomar Health’s website, except that a court or arbitrator will be bound by rulings in prior arbitrations involving the same Palomar Health website user, to the extent required by applicable law. The award of the arbitrator shall be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

  1. Arbitration Costs: Payment of all JAMS or arbitrator fees will be governed by JAMS’ rules, unless otherwise stated in these Terms of Use. If you are able to demonstrate that the costs of accessing arbitration will be prohibitive as compared to the costs of accessing a court for purposes of pursuing litigation on an individual basis, Palomar Health will pay as much of the JAMS or arbitrator fees as the arbitrator deems necessary to prevent the cost of accessing the arbitration from being prohibitive. Any request for payment of fees by Palomar Health must be submitted by mail to JAMS along with your Demand for Arbitration. In the event the arbitrator determines that either the substance of your or Palomar Health’s claim or the relief sought was frivolous or brought for an improper purpose, then you or Palomar Health may seek to recover from you or Palomar Health any fees paid, including attorneys’ fees, to the extent permitted by JAMS’ rules and applicable law.
  2. Severability: You and Palomar Health agree that all of the terms in these Terms of Use are severable. You and Palomar Health agree that, if a court decides that any part of these Terms of Use is invalid or unenforceable, the other parts of these Terms of Use still apply. You further agree that, if any disputes are determined by a court not to be subject to arbitration, then those disputes must be severed from any other disputes and may be litigated in court, with the remaining claims heard in arbitration.
  3. Choice of Law: You agree that, except to the extent inconsistent with or preempted by federal law and except as otherwise stated in these Terms of Use, the laws of the State of California, without regard to principles of conflict of laws, will govern these Terms of Use and any claim or dispute that has arisen or may arise between you and Palomar Health.

Opt-Out Procedure: You can choose to reject the arbitration provisions of these Terms of Use by mailing us a written opt-out notice. The opt-out notice must be postmarked no later than 30 days after the date you accept these Terms of Use for the first time. You must mail the opt-out notice to:

Your opt-out notice must contain the following information: Your name, your address, and the first date after August 11, 2023, on which you first accessed Palomar Health’s website.     After I complete my application, how long will it be until I can start volunteering?

    From the time you submit your volunteer application, it may take up to six weeks to fully complete the screening process. Our goal is to match your interests and availability with our needs. With over 400 volunteers at Palomar Health, we do our best to match each department’s volunteer needs based on your interests, availability and skills. It is our responsibility to ensure the safety of our patients through a thorough screening process.

    Now that I have submitted my application, what is the next step? What types of onboarding tasks will I need to complete as a part of my onboarding process?

    Why do I have to be interviewed?

    The online interview process allows us a chance to determine whether we can meet your interest and expectations as a volunteer and ensure a great experience with Palomar Health. This is a great opportunity for volunteer candidates to ask questions and ensure they want to join our volunteer team. All volunteer applicants are interviewed by a member of the Volunteer Services Interview Committee.

    Must a parent/guardian be present for Junior Volunteer interview, orientation and TB test?

    Yes. We have determined that these are discussions with the volunteer candidate that involve commitments or hospital procedures and feel that an adult should be present as a witness and for their own awareness.

    Why do you ask for the contact information for a school counselor/advisor for Junior Volunteers and College Students?

    We welcome student applicants who will fit in with our core values of: Integrity, Trust, Compassion, Teamwork, Excellence and Service. Historically we have had issues with students not following their schedule and lack of communication for unexpected absences. Having a school counselor/advisor who we can include in communications if we see a problem will raise the accountability of our volunteers. Volunteer services at Palomar Health offers students a lot of opportunities to learn about healthcare and serve their community. We are looking for students who are serious about their commitment to volunteer once they join our team. Ultimately, we want the students to be successful.

    For school, do I need to do an internship with periodic reports of my hours and progress as well as an end-of-term evaluation?

    We can confirm your reported hours but we do not do progress reports or an end-of-term evaluation.

    How old do I have to be to volunteer?

    Volunteers must be at least 16 years old.

    Why is there a fee to volunteer?

    The processing fee partially covers the cost of the Tuberculosis (TB) screen, background check and funds the account for purchasing uniforms and badge parts.

    The volunteer processing fee seems higher than most. Why?

    As mentioned, the processing fee partially covers the cost of the TB screen, background check and the account for purchasing uniforms and badge parts. After 100 hours of service in an eight-month period, and if the volunteer is in good standing, we will return $50 upon request. We have found this to be a good incentive to encourage volunteers to complete their 100-hour commitment.

    What type of TB test is used by Employee/Corporate Health?

    It is a QuantiFERON Gold blood draw test.

    I just had a TB test for school or my job. Do I have to take another one?

    If you had the test within the last three months (90 days) send a scanned copy of the results paperwork to Volunteer@PalomarHealth.org and we will forward it to Employee Health. If they accept it, you do not need to take another test.

    I was exposed to TB in the past and always test positive. Does that exclude me?

    Not necessarily. If your results show positive, Employee Health will want to take a chest x-ray to see it is active. If you expect this to be the case, let Employee Health know when you are tested and perhaps they can schedule the x-ray for the same time to save you a second trip.

    Why is the background check required?

    All volunteer applicants are required to complete a background check prior to being accepted into the program. At Palomar Health, we take the safety of our patients, families and staff very seriously. For this reason, every prospective volunteer must complete a thorough online background check. You will be provided a link to complete the background check and the results will be reviewed by our team.

    Are all volunteers expected to serve a minimum of 100 hours?

    Yes. If you feel you cannot uphold these service commitments, we encourage you to explore volunteering opportunities elsewhere.

    Can I volunteer at both the Escondido and Poway hospitals?

    You can only volunteer at one location at a time.

    Can I do court-ordered community service by volunteering?

    We do not accept volunteers with court-ordered short term or one time community service.

    I’m only interested in volunteering with babies in the Neonatal Intensive Care Unit (NICU). Are there opportunities available and what are the requirements?

    Volunteering in the Palomar Health Neonatal Intensive Care Unit (NICU) as a Baby Cuddler is an advanced opportunity that is only available to our current volunteers. To be considered for placement in the NICU Baby Cuddling program, interested individuals must first volunteer a minimum of 100 hours in another area. There are also immunization requirements specific to this assignment.

    Advanced Role Volunteers

    Some roles within Volunteer Services require additional training and experience.

    • Volunteers need to have served a certain number of hours before moving into an advanced role.
    • Volunteers in advanced roles require extra training specific to the role they are serving in.
    • Volunteers must be mature and self-starters.

    Once I’ve reached my 100 service hours, what comes next?

    Once you reach 100 service hours, we are happy to write a letter of recommendation for our volunteers who are applying to school, for a scholarship or for employment. If you wish to continue to volunteer past the 100-hour minimum requirement, we encourage our volunteers to do so. We have volunteers who have served for over 30 years and hope you will find the same fulfillment as these dedicated individuals.

    What is a 100-Hour letter?

    It is a letter of recommendation given, when requested, to volunteers in good standing who have completed 100 hours of service. It is sometimes required for an academic class, or school application or employment.

    What time commitment do I need to make as a volunteer?

    We ask that you commit to volunteer four hours weekly, but you are welcome to do much more. Volunteers who serve the minimum weekly service hours usually take about 6 months to complete the 100-hour requirement. If you want to volunteer more than four hours weekly, that is always an option.

    Are all Palomar Health volunteers expected to commit to a regularly scheduled, four-hour shift each week?

    Yes. Junior Volunteers (age 16 to 17) can optionally do a four-hour shift every other week.

    Are all volunteers required to wear uniforms?

    Yes, all volunteers are required to wear a uniform. We have an established dress code that applies to all individuals volunteering at Palomar Health. The uniform consists of a teal smock, polo shirt or t-shirt that is provided to volunteers. White, black or khaki (tan) long pants and black or white closed toe/closed heeled shoes are also required and are the responsibility of the volunteer. The only exception is Chaplain service volunteers who wear professional attire.

    Why do you want the uniform and badge returned when I stop volunteering?

    The uniform and badge are recognized by Security and other hospital staff and allow unobstructed entrance into the hospital buildings. For the safety of staff and patients, we need to manage who has access to our facilities.

    Can I complete my high school senior project at Palomar Health?

    You may complete your high school senior project at Palomar Health but must be willing to commit to the 100-hour service requirement. Keep in mind that we do not do internships with periodic reports of your hours and progress, nor will we complete an end-of-term evaluation.

    Is an internship different than volunteering?

    An unpaid internship here at Palomar Health is coordinated through the Pathmaker Internship program. Please visit the Pathmaker Internship webpage for more information.

    Can I still volunteer even though I am looking for a job?

    If your overall goal and objective is to have a career at Palomar Health, please visit the Careers Page to view job postings. In the meantime, we would love to have you volunteer with us.

    Are volunteers required to wear masks?

    Volunteer Services follow hospital protocols which are directed by the CDC. At present, masks are not required due to COVID-19. However, during flu season masks are required as an alternative to getting the flu vaccine from late October to the end of March.
